Service Limitations and Scope

Independent Contractor Relationships: Teachers using our platform are independent contractors who provide their services directly to families. Data Security Measures

Security Infrastructure: We implement comprehensive technical, administrative, and physical security measures to protect user data from unauthorized access, disclosure, alteration, and destruction. Our security program meets industry standards and is regularly updated to address emerging threats and vulnerabilities.

Encryption and Access Controls: We use encryption to protect data both in transit and at rest, and we implement strict access controls to ensure that only authorized personnel can access user data for legitimate business purposes. All access to user data is logged and monitored for security purposes.

Incident Response: We maintain detailed incident response procedures to address potential security breaches or privacy incidents. In the event of an incident that may affect user data, we will notify affected users and relevant authorities as required by applicable laws and will take immediate steps to contain and remediate the situation.

Regular Security Audits: We conduct regular security audits and assessments to ensure the ongoing effectiveness of our security measures and to identify opportunities for improvement. We also work with third-party security experts to conduct penetration testing and vulnerability assessments.

Platform Availability and Modifications

Service Availability

Best Efforts Commitment: We strive to maintain high levels of service availability and performance, implementing redundant systems and monitoring tools to minimize service disruptions. However, we cannot guarantee uninterrupted access to our Service due to factors that may be beyond our control, including internet infrastructure issues, third-party service dependencies, and necessary maintenance activities.

Planned Maintenance: We perform regular maintenance and updates to improve our Service and maintain security. We provide advance notice of planned maintenance that may significantly impact service availability, typically scheduling such activities during periods of low user activity to minimize disruption to our educational community.

Emergency Maintenance: In some cases, emergency maintenance may be necessary to address security vulnerabilities, critical bugs, or other urgent issues. While we strive to provide advance notice when possible, emergency maintenance may be implemented immediately when necessary to protect user safety and platform security.

Service Dependencies: Our Service depends on various technical components including cloud infrastructure, third-party integrations, and internet connectivity. While we implement redundancy and backup systems where possible, service availability may be affected by issues with these dependencies that are beyond our direct control.

Service Modifications and Updates

Continuous Improvement: We continuously enhance our Service by adding new features, improving existing functionality, and updating our technology infrastructure. These improvements are designed to enhance user experience, improve matching accuracy, and maintain platform security and performance.

Feature Changes: We may modify, suspend, or discontinue any feature or functionality of our Service at any time. While we strive to provide advance notice of significant changes that may affect user workflows, some modifications may be implemented immediately for security or operational reasons.

User Interface Updates: We may update the user interface and user experience of our Service to improve usability, accessibility, and functionality. We provide support resources and guidance to help users adapt to interface changes and take advantage of new features.

Backward Compatibility: We make reasonable efforts to maintain backward compatibility when making changes to our Service, though some updates may require users to modify their content or workflows to maintain full functionality. We provide migration tools and support when significant changes are necessary.

Prohibited Uses and Community Standards

This includes content that promotes violence, hatred, or illegal activities, or that could harm the safety and well-being of other users.

Platform Abuse: Users may not engage in activities that abuse or compromise our platform, including attempting to circumvent security measures, creating multiple accounts to evade restrictions, or using automated tools to manipulate our systems or services.

Unprofessional conduct includes inappropriate communications, boundary violations, conflicts of interest, or behavior that undermines the trust and safety of our educational community.

Termination and Suspension

User-Initiated Termination

Account Deletion: Users may terminate their accounts at any time by following the account deletion procedures in their account settings or by contacting our customer support team. Account deletion results in the removal of user data in accordance with our data retention policies and applicable legal requirements.

Subscription Cancellation: Users may cancel their premium subscriptions at any time without penalty. Cancelled subscriptions remain active until the end of the current billing period, after which accounts revert to free tier access levels. Users retain access to purchased courses and resources even after subscription cancellation.

Data Export: Before terminating their accounts, users are encouraged to export any important data or content they wish to retain. We provide tools to facilitate data export, including profile information, communications, and educational resources, though users are responsible for initiating the export process before account deletion.

Gradual Transition: We provide support for users who wish to gradually reduce their platform engagement before full account termination, including options to pause subscriptions, limit profile visibility, or temporarily restrict account activity.

TeacherX.app-Initiated Termination

Terms Violations: We may suspend or terminate user accounts for violations of these Terms, including prohibited uses, inappropriate conduct, or failure to comply with our community standards. We typically employ a graduated response approach, starting with warnings and temporary restrictions before proceeding to account termination.

Safety and Security: We may immediately suspend or terminate accounts when necessary to protect the safety and security of our users and platform. This includes cases involving potential harm to minors, fraudulent activities, or security threats that require immediate action.

Legal Requirements: We may terminate accounts or restrict access as required by law, court orders, or regulatory requirements. In such cases, we will comply with legal obligations while providing appropriate notice to affected users when legally permitted.

Service Quality: We may terminate accounts that consistently violate our quality standards or community guidelines, particularly in cases where users repeatedly receive complaints or fail to meet professional standards expected in our educational community.

Suspension Procedures

Temporary Suspension: We may temporarily suspend accounts while investigating potential violations, safety concerns, or disputes between users. During suspension, users may have limited access to their accounts and data, and we will communicate the reason for suspension and expected resolution timeline.

Appeal Process: Users whose accounts are suspended or terminated have the right to appeal these decisions through our established appeal procedures. We provide fair and reasonable appeal processes that include review by appropriate staff members and consideration of additional information provided by users.

Restoration Procedures: In cases where suspensions are lifted or appeals are successful, we provide clear procedures for account restoration and will work to minimize any negative impact on users' platform engagement and relationships.

Communication During Suspension: We maintain communication with suspended users throughout the review process, providing updates on investigation status and clear information about steps needed for potential account restoration.

Effects of Termination

Data Retention: Upon account termination, user data is handled in accordance with our data retention policies and applicable legal requirements. Some data may be retained for limited periods to comply with legal obligations or to protect the rights and safety of other users.

Service Access: Terminated users lose access to our Service and most account-related data, though purchased courses and resources may remain accessible through alternative arrangements in some cases.

Community Impact: Account termination may affect ongoing tutoring relationships, community participation, and marketplace activities. We provide support to minimize disruption to other users who may be affected by account terminations.

Survival of Terms: Certain provisions of these Terms survive account termination, including intellectual property rights, limitation of liability, dispute resolution procedures, and any ongoing obligations related to past platform use.

Educational Outcomes: While our Service is designed to facilitate connections between qualified teachers and families seeking educational support, we do not guarantee specific educational outcomes, academic improvements, or tutoring success. Force Majeure and External Factors

Unforeseeable Events: We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor disputes, internet infrastructure failures, or technical failures of third-party services.

This includes claims related to educational malpractice, inappropriate conduct, or failure to meet professional standards.

Marketplace Activities: Users who participate in our educational resource marketplace are responsible for indemnifying us against claims related to their resources, including intellectual property infringement, quality issues, or misrepresentation of content.
